(CONFIDENTIAL) PINCKNEYVILLE (PERRY COUNTY),

ILLINOIS As Belleville, Illinois Probate Lawyers, we were involved in the ouster of a trustee in a contested trust litigation in Pinckneyville, Perry County, Illinois regarding a Trust in excess of $1,000,000.00.  Within weeks of the decedent’s death, the trustee had taken in excess of $50,000.00 from the Trust.  After that, the trustee unlawfully took another $75,000.00 from the Trust.  The trustee was luting the Trust and we filed a lawsuit on behalf of a beneficiary.  We took the position this was a rogue trustee who was basically acting in his own self-interests.  This case involved Estate and Trust Litigation Law Firms in the Twentieth Judicial Circuit Court of the State of Illinois.

(CONFIDENTIAL) COLUMBIA (MONROE COUNTY), ILLINOIS 

As Waterloo, Monroe County, Illinois, Probate Lawyers, we were involved in a contested estate and trust in Monroe County Circuit Court representing beneficiaries in a trust controversy in excess of $1,500,000.00.  The decedent passed away leaving children who were quarreling over real estate.  A resolution was reached whereby a portion of the real estate located near State Route 156 was sold to Waterloo School District Number 5.  There were also issues raised regarding the trustee making premature distributions of trustee’s fees without notice and not pursuant to Court Order.  That case involved various Estate and Trust Litigation Attorneysin Waterloo and Columbia, Illinois.

As Metro-East, Illinois Will/Trust Attorneys, we were hired by Co-Executors and Co-Trustees in regard to an Estate and Trust of a decedent who passed away in St. Clair County, Illinois having assets in excess of $10,000,000.00.  We took the position that under the facts and circumstances of the case, no estate taxes were due.  We published appropriate notice in regard to the estate administration and the trust administration and took the position that any estate contests or trust contests should be barred because none were timely filed under applicable law.  That case involved an Estate and Trust Litigation Law Firm in BellevilleSt. Clair County, Illinois.

As Probate Litigation Attorneys, we became involved in an estate administration which concerned real estate in Belle Rive, Jefferson County, Illinois.  Through a series of real estate transactions, a portion of farmland had not been conveyed as parties had thought and it was part of a contested estate.  A resolution was reached in regard to beneficiaries of the estate agreeing to quit claim their interest in settlement.  That case involved an Estate and Trust Law Firm from Belleville, Illinois and Probate Counsel from Mt.  As Experienced Will and Trust Counsel in Southern Illinois, we were requested to act as an expert witness by counsel in regard to a will contest litigation involving in excess of $3,000,000.00 in St. Clair County Circuit Court.  In that case there were disputes regarding the construction of language used in the Will, including whether or not the language in a specific bequest preempted language providing for disposition of the rest, residue and remainder of the estate.  After being hired by the attorneys representing the litigants, and after reviewing documentation and researching authorities, we gave an expert opinion and the case was settled.  That case involved Will Contest and Contested Trust Attorneys in Swansea, Illinois and Belleville, Illinois.

 As Southern Illinois Probate Lawyers, we represented an out-of-state beneficiary where the decedent passed away a resident of the State of Illinois having in excess of $500,000.00 in assets.  The executor of the estate had favored her own financial interests prior to date of death of the decedent, including in regard to the establishment of a joint tenancy banking account with the decedent, as well as after date of death, by making inappropriate distributions from the estate, to the detriment of other beneficiaries, including our client.  That case involved various Estate andTrust Attorneys in Belleville, Illinois.

 As Illinois Estate and Trust Litigation Lawyers in Southern Illinois, we were involved representing a party in a will contest having to do with a Power of Attorney breaching fiduciary duties to favor his own self-interests.  Before the decedent passed away, his son obtained Power of Attorney from another lawyer and engaged in a series of transactions to basically deplete the estate of certain real estate and personal property, in excess of $500,000.00, such that when his father passed away there would be less of the estate passing to the decedent’s surviving spouse and other children.  This case involved improper signatures, improper notaries and fraudulent transactions.  This case involved Multiple Law Firms Practicing Estate and Trust Litigation in St. Clair County and Madison County, Illinois.

(CONFIDENTIAL) ESTATE – BELLEVILLE (ST. CLAIR COUNTY), ILLINOIS

As Metro East, Illinois Probate Attorneys, we were involved in a complex contested guardianship proceeding that was followed by a trust contest case.  There were issues relating to undue influence, duress and lack of mental capacity.  Our clients received a settlement in excess of $840,000.00 without going to trial.  That case involved numerous Estate Litigation Law Firms in St. Clair County, Illinois.

As Belleville, Illinois Trust Litigation Attorneys, we were involved in trust litigation that encompassed removal of a trustee and setting aside a trust.  After lawsuits were filed to remove the trustee based on numerous breaches of fiduciary duties and attacking the validity of a trust based on various grounds, a settlement was reached whereby our client received a distribution in excess of  $900,000.00.  Those lawsuits involved lawyers from St. Clair County, Illinois and lawyers from Perry County, Illinois.

As O’Fallon, Illinois Probate Lawyers, we were involved in a case where a widower that had no children made an estate plan regarding $2,500,000.00 in assets, first giving the bulk of his estate to unrelated acquaintances in O’Fallon, Illinois.  He then changed his estate plan to provide for most of his estate to be received by his long-time Tenant Farmer.  After that, he changed his estate plan to be received by his family.  After resolving will contest issues, his assets were distributed to his blood relatives.  That case involved Estate Planning and Trust Litigation Law Firms in Belleville, St. Clair County, Illinois.

As Freeburg, Illinois Estate and Trust Attorneys, a beneficiary hired us in regard to a probate administration involving less than $500,000.00 which had been proceeded by separate lawsuits before the decedent passed away concerning other family matters which impacted the estate of the decedent.  Even though our client had been given the decedent’s home in his mother’s estate planning documents, there was a claim by other family members that the home had to be sold to pay liabilities and debts of the decedent.  A resolution was reached whereby our client received the home that had been given to him by his mother in her estate plan.  That matter involved Trust and Will Contest Law Firms in Freeburg, Illinois and Belleville, Illinois.

As Salem, Illinois Probate Attorneys, we represented a client in a Contested Estateinvolving in excess of $250,000.00 in Marion County Circuit Court.  Our client’s sister, if not others, exerted undue influence, and received a portion of the mother’s assets prior to her death, to the detriment of our client.  The Court allowed our client to proceed with filing pleadings in regard to a Will Contest, even though our client was not named as a beneficiary in the Will that was being administered.  That case involved Estate and Trust Litigation Lawyers from Centralia, Illinois and Belleville, Illinois.

As St. Clair County, Illinois estate attorneys we were involved in the (Confidential) Estate.  Issues included various changes to estate planning documents of an elderly person prior to her death. St. Clair County, Illinois estate attorneys in Belleville, Illinois and BellevilleIllinois probate attorneys were involved in that proceeding.There was more than $1,000,000.00 involved in that trust and estate administration proceeding in Twentieth Judicial Circuit, Illinois.

(CONFIDENTIAL) ESTATE – BLOOMINGTON (MCLEAN COUNTY), ILLINOIS

As Belleville, Illinois probate attorneys, we were hired to provide representation in regard to the (Confidential) Estate in McLean County, Illinois.  Issues included the decedent borrowing substantial unsecured amounts and competing estate claims in regard to a contracting business of the decedent.  Bloomington, Illinois estate attorney was involved in that proceeding.There was more than $1,000,000.00 involved in that Eleventh Judicial Circuit, Illinois proceeding in Bloomington, Illinois.

(CONFIDENTIAL) ESTATE – BELLEVILLE (ST. CLAIR COUNTY), ILLINOIS

As Metro East, Illinois probate attorneys, we were involved in a complext contested guardianship proceeding that was followed by a trust contest case.  There were issues relating to undue influence, duress and lack of mental capacity.  Our clients received a settlement in excess of $840,000.00 without going to trial.  That case involved numerous estate litigation law firms in St. Clair County, Illinois.

(CONFIDENTIAL) – DUQUOIN (PERRY COUNTY), ILLINOIS

As Belleville, Illinois trust litigation attorneys, we were involved in trust litigation that involved removal of a Trustee and setting aside a trust.  After lawsuits were filed to remove the trustee based on numerous breaches of fiduciary duties and attacking the validity of a trust based on various grounds, a settlement was reached whereby our client received a distribution in excess of  $750,000.00.  Those lawsuits involved lawyers from St. Clair County, Illinois and lawyers from Perry County, Illinois.

(CONFIDENTIAL) TRUST – BELLEVILLE (ST. CLAIR COUNTY), ILLINOIS

We represented an Executor and Trustee in a St. Clair County, Illinois litigation that involved complex contested issues relating to in excess of $8,000,000.00, including transfers prior to the decedent’s death to his wife and stepchildren.  Issues related to removal of the personal representative, including for reasons based on allegations of breaches of fiduciary duty and mismanagement of the Estate and Trust.  That case involved numerous lawyers concentrating in Estate and Trust Litigation in the Twentieth Judicial Circuit, Illinois.
