We frequently discuss with clients the use of a revocable living trust to avoid probate. Simply stated, what is owned by the trust as the date of death is not owned by the decedent. Since there are estate administration provisions in the applicable statute, estate administration can often times be avoided by the use of revocable living trusts. Furthermore, there may be strategies in regard to potential will contests versus trust contests which could make it recommended that revocable living trusts be utilized as a further protection in regard to any contests after date of death.
